All-Star memories will linger for Rays.

National uprising: N.L. wins All-Star game for first time since 1996.

The Rays have a record of 54-34 at the All-Star break. They're 9-2 in July, have won 8 of their last 9 and 11 of their last 15, and are second in the A.L. East, 2 games behind the Yankees and 3 ahead of Boston. After MLB's All-Star break, the Rays head out for nine games, starting with a huge three-game set at the Yankees beginning on Friday. Tampa Bay will also play three at Baltimore and three at Cleveland, before returning home on Monday, July 26th for their longest home stand of the season, 11 games, with the first of a four-game set against Detroit, to be followed by three against the Yankees and four against Minnesota. You can follow the Rays on 620AM WDAE and the Rays Radio Network. Saturday's game at the Yankees can be seen on FOX at 4:00pm EDT. All other games can be seen on Sun Sports.

Today is the 100th birth anniversary of William Hanna (1910-2001), co-creator with Joe Barbera of Academy Award-winning Hanna-Barbera animated shorts. (Flintstones, meet the Flinstones, they're the modern stone-age family. From the town of Bedrock, they're a place right out of history. Someday, maybe Fred will win the fight, and that cat will stay out for the night. When you're with the Flintstones, have a yabba-dabba-doo time, a dabba-doo time, we'll have a gay ol' time!)

Appeals Court Strikes Down FCC 'Fleeting Expletives' Indecency Policy.

The FCC's "fleeting expletives" indecency rules were thrown out by a three-judge panel of the Second Circuit Court of Appeals Tuesday. The ruling, responding to the Commission's determination that the expletives, heard in two editions of the Billboard Music Awards on FOX television, were actionably indecent was "unconstitutionally vague, creating a chilling effect that goes far beyond the fleeting expletives at issue here." The Court also indicated that the entire Commission indecency policy was invalid.

"We agree with the networks that the indecency policy is impermissibly vague," the court, in a decision written by Judge Rosemary Pooler, said. "It results in a standard that even the FCC cannot articulate or apply consistently."

FOX issued a statement saying the network is "extremely pleased with the decision handed down today by the Second Circuit. We have always felt that the government's position on fleeting expletives was unconstitutional. While we will continue to strive to eliminate expletives from live broadcasts, the inherent challenges broadcasters face with live television, coupled with the human element required for monitoring, must allow for the unfortunate isolated instances where inappropriate language slips through."

The case is now likely headed back to the Supreme Court on appeal by the Commission.

NAB Comments

Commenting on the court ruling, NAB EVP/Communications DENNIS WHARTON issued the following statement:

"NAB supports Today’s (Tuesday) appellate court decision. As broadcasters, we will continue to offer programming that is reflective of the diverse communities we serve. We believe that responsible decision making by network and local station executives, coupled with program blocking technologies like the V-chip, is far preferable to government regulation of program content."
